Hello all


Can anyone explain the apparent new (or old) taxes being instigated on people renting their homes on a holday rental business?

Hi. Firstly I am not sure what your question means.
If a homeowner has a residence secondaire and wishes to rent it out to tourists then they normally declare their revenue on their declaration d'impots under the BIC system . If they have a revenue over a certain threshold ( around the 23000 euros I think) then they have to set up with RSI and pay cotisations as well as declaring on their tax form. Obviously this is a sort of grey area and some people declare nothing or a very small amount.
If the homeowner is not resident in France it is obviously a bit more complicated and if they do wish to be completely honest then it would be best to seek advice through an accountant as to what regime would be the best. I know someone who does through the regime réel system as a non resident , this way they use an accountant to knock off all expenses etc and so the actual earnings are a minimum.
If you are talking as a company that has a home used just for rentals then it would be best to find a good accountant to advise you. The micro enterprise system is good for most people as they just declare the trimestrial earnings, but they cannot offset any expenses under this regime.

As in everything in French Law there may be other clauses more advantageous to your circumstances. The specific one quoted by Martyn favours French locals and may have been subsequently challenged.

Alas. Conventional advice to seek out an accountant is not foolproof in such issues. It all depends..
