Good morning,

We are writing to you as our last MP (for whom we both voted) when we resided in the UK at ............. We continue to vote even though we now live in France as expats.

We are going to lose our Winter Fuel Payment, which matters to us so please therefore will you sign EDM 695 which is a prayer against the Statutory Instrument.

We think this is unfair because:

1. The DWP have included the French DOMs to establish winter temperatures. The French DOMs are not treated as mainstream France for any other purpose. Treaty of Lisbon, article 349 provides that for purposes of European law the DOMs may be treated seperately from France.

2. It is unfair to list France as warmer on average in winter than the south-west of England, because without the French DOMs the temperature of mainland France it is actually colder only 4.9C compared to 5.6C in SW England.

3. The research used by the DWP was unusual in using a five-month period (November to March) to represent “winter”. As there are 4 seasons how long has a year now become?!

4. We think the Statutory Instrument unfairly allows the WFP to people living in Italy, even though its temperature was found to be 5.7C

5.The European Commission reported in July 2013 that the WFP is considered to be a normal old-age benefit, which should be paid to all those entitled to it even if they move to another member state. As a general principle it is therefore discriminatory to refuse it to people moving outside the UK in the EU or to give it to those in certain countries and not others. Under existing rules, WFP recipients can continue to have it if they choose to move in the EU, and people can claim it for the first time from other EU countries if they are of the qualifying age and can show a "sufficient link with the UK's social security system" (such as working in the UK and paying National Insurance for a significant period).

Please can you be kind enough to confirm that you have signed EDM 695.

sorry if Im being thick Sue, it wouldn't be my first time, but what does 'signed by Facebook' mean?

You need to send a personal letter or email to your MP in the constituency you last voted at in the UK.

I meant that it was posted by someone on Facebook and I used that posting to send my email. Have also signed the Petition that has been going around Facebook.
